ShelfPro Terms of Service

By downloading, installing, accessing, or using the ShelfPro mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and NicheLink LLC (“Company,” “we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.
1. ACCEPTANCE OF TERMS
By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional policies referenced herein.
2. DESCRIPTION OF SERVICE
ShelfPro is a professional mobile application designed for retail merchandising, sales representatives, and brand specialists across all consumer product categories to:
• Manage retail store accounts and store information
• Catalog products using barcode scanning and manual entry
• Generate professional point-of-sale materials including shelf tags, shelf talkers, and sales sheets
• Create and manage shelf reset plans and planograms
• Design custom merchandising layouts and schematics
• Export and import product data
• Access premium features through subscription plans
ShelfPro serves professionals in beverage, food, consumer goods, and other retail product categories.
3. SUBSCRIPTION PLANS AND BILLING
3.1 Subscription Plans
ShelfPro offers:
• Monthly Subscription: $19.99 per month
• Annual Subscription: $199.99 per year
• Free Trial: 7-day limited trial period (where available)
3.2 Auto-Renewal
Subscriptions automatically renew unless you cancel before the renewal date.
3.3 Free Trial
Your subscription auto-starts at the end of the 7-day trial unless canceled at least 24 hours before the trial ends.
3.4 Billing and Payment
All billing is handled by the Apple App Store or Google Play Store. Payments are charged at purchase confirmation. Auto-renewal is managed in your device’s subscription settings.
3.5 Cancellation Policy
You may cancel at any time:
• iOS: Settings → Your Name → Subscriptions → ShelfPro
• Android: Google Play Store → Subscriptions → ShelfPro
Cancellation applies at the end of the billing period. No partial refunds.
3.6 Refund Policy
Refunds must be submitted to:
• Apple: https://support.apple.com/billing
• Google: https://support.google.com/googleplay/answer/2479637
NicheLink LLC does not process refunds directly.
3.7 Price Changes
We may adjust pricing in the future.
3.8 Subscription Benefits
Premium features include:
• Store and product management
• Shelf tags, shelf talkers, and sales sheet generation
• Reset planning and schematic tools
• Planogram layouts
• Import/export features
• All future updates included
4. USER ACCOUNTS AND DATA
You are responsible for keeping your account secure. ShelfPro stores data locally and uses secure encryption. We encourage regular exports for backup.
5. ACCEPTABLE USE
You may not:
• Reverse engineer the app
• Attempt unauthorized access
• Use the app for illegal activity
• Violate laws or regulations
• Disrupt or interfere with app functionality
Violation may result in account termination without refund.
6. INTELLECTUAL PROPERTY
ShelfPro’s software, code, design, and branding are owned by NicheLink LLC.
Users retain ownership of content they upload or create. By using ShelfPro, you grant NicheLink LLC permission to store and process your content solely to provide app functionality.
7. PRIVACY AND DATA COLLECTION
Minimal data is collected. Subscription management is handled through RevenueCat and app stores.

8. DISCLAIMERS AND LIMITATIONS OF LIABILITY
8.1 “As Is” Service
ShelfPro is provided “as is” without warranties of any kind.
8.2 No Guarantee of Availability
We do not guarantee uninterrupted or error-free service.
8.3 Limitation of Liability
NicheLink LLC is not liable for indirect, incidental, or consequential damages, including loss of revenue or data.
8.4 Maximum Liability
Maximum liability is limited to the subscription amount paid in the prior 12 months.
9. INDEMNIFICATION
You agree to indemnify NicheLink LLC against claims arising from:
• Your use of the app
• Violations of these Terms
• Any content you submit
• Third-party rights violations
10. TERMINATION
10.1 User Termination
You may terminate by uninstalling the app and canceling your subscription.
10.2 Company Termination
We may suspend or terminate access for violations or fraudulent activity.
10.3 Effect of Termination
All rights to use the app end immediately upon termination. Certain provisions survive termination (liability limits, IP rights, indemnification).
11. UPDATES AND MODIFICATIONS
11.1 App Updates
We may release updates or required improvements.
11.2 Terms Modifications
We may modify these Terms. Continued use after changes constitutes acceptance.
12. DISPUTE RESOLUTION
12.1 Governing Law
These Terms are governed by the laws of the State of Texas, USA.
12.2 Arbitration
Disputes will be resolved by binding arbitration under the American Arbitration Association.
12.3 No Class Actions
Disputes must be individual; class actions are waived.
12.4 Exceptions
Either party may seek court relief for intellectual property protection.

If there is any conflict, app store terms take precedence.
